Parental Rights Amendment

DRAFT PARENTAL RIGHTS AMENDMENT FOR THE UNITED STATES CONSTITUTION

SECTION 1
The liberty of parents to direct the upbringing and education of their children is a fundamental right.

SECTION 2
Neither the United States nor any state shall infringe upon this right without demonstrating that its governmental interest as applied to the person is of the highest order and not otherwise served.

SECTION 3
No treaty nor any source of international law may be employed to supersede, modify, interpret, or apply to the rights guaranteed by this article.

  1. My feedback is that I’m not sure this is an issue needing a plank. I largely agree with this wording, although it’s a bit too vague to be especially meaningful.

    Sections seem unnecessary. I’m not sure what “the highest order” is. I do think that there’s such a thing as parental child abuse, and for the foreseeable future, state intervention seems reasonable to stop child abuse in specific and rare cases. I’d suggest wording this differently, if you intend to proceed with this plank.

    It’s “supercede.” “[t]his article” dangles…what article?

  2. This is a proposed amendment to the United States Constitution. I did not write it, and it has nothing to do with the Libertarian Party platform.

    Many of my comments apply to any constitutional amendment, though.

  4. Section 2 is too weak. What does “highest order” and “demonstrate” mean in a court of law.

    Here’s a better version:

    SECTION 2
    Neither the United States nor any state shall infringe upon this right unless the child is proven by a jury to be in clear and obvious danger of physical harm or abuse by the parent or guardian.
